The following Terms & Conditions apply when customers (hereinafter referred to as “The Customer”) book tours with Icethor.is or úlfhéðinn slf (hereinafter referred to as “Icethor.is”) and/or tours sold by Icethor.is that are serviced by a 3rd party.

Note that for certain tours, additional tour-specific Terms & Conditions may apply. Some tours/services may require The Customer to sign service-specific waivers on date of departure that contain articles not included herein. The fore-mentioned can also apply for tours sold by Icethor.is but serviced by a 3rd party. The Customer is urged to contact Icethor.is to inquire if this applies to a tour that The Customer has booked or intends to book. Please e-mail to icemotion@outlook.com with such queries.

Entirety of Agreement

The Terms & Conditions set forth herein and, where applicable, in our tour-specific Terms & Conditions, constitute the entire agreement between Icethor.is and The Customer and supersede any communications or previous agreements with respect to the subject matter of this Agreement. There are no written or oral understandings directly or indirectly related to this Agreement that are not set forth herein. No change can be made to this Agreement other than confirmed in writing by both parties.

Taxes and fees
All prices on the website include VAT and invoices are issued with VAT as well.

General Conditions and Liability

Icethor.is disclaims responsibility for any loss, damage, accidents, illness,death or changes in schedules caused by weather, strikes or any other irregularity outside Icethor.is control. Icethor.is reserves the right to alter routes or departure times, without prior notice, should the necessity arise. We advise all customers to have insurance, as customers are on their own responsibility on optional tours and some activities may fall outside of the terms of regular travel- and/or accident insurance.

No responsibility is taken for losses or expenses due to delay or changes of flights, injury, damage of possessions, negligence, weather, war or other unforeseeable causes. The estimated duration of tours as indicated on our website are standard times and can vary according to road or weather conditions. Icethor.is cannot be made responsible for losses that a customer may face due to delay, regardless whether the loss is direct or indirect.

In cases where Icethor.is needs to contact The Customer regarding changes or cancellation of tours, an e-mail is sent to the e-mail address provided by The Customer during the booking process. The Customer is urged to monitor e-mails before scheduled departures. If The Customer is unable to access e-mails and needs other means of communications The Customer is responsible for providing Icethor.is with alternative means of communication.

 

Confidentiality
Icethor.is respects our clients privacy rights and will hold all information from the buyer in relation to the purchase as confidential. Under no circumstances will information be handed to a third party.

Cancellation and refund Policy

All cancellations by The Customer must be made in writing to icemotion@outlook.com

Cancellation/refund terms if cancelled by The Customer:

  1. If cancelled less then 3 days prior to the tour 50% refund  

  2. If cancelled Less than 24 hours prior to beginning of tour: No refund

  3. If The Customer fails to show up at pickup: No refund.

  4. if cancelled more then 3 days prior to the tour 100% refund.

 

Cancellation/refund terms if cancelled by Icethor.is 

  1. If a tour is cancelled, for any reason at any time, The Customer is eligible for a 100% refund of the ISK amount originally paid.

  2. This does not include tours that are free re-runs (such as after non-sightings Northern Lights tours).

  3. Under no circumstances is The Customer eligible for a refund in part or full for a tour that was performed.

  4. Icethor.is conducts business in the Icelandic Krona (ISK). When purchasing a tour online, Customer is, in effect, entering into an agreement with the bank, that issued Customers credit card, to purchase Icelandic Krona which Customer in turn uses to pay for Icethor.is  services. Icethor.is refunds the exact same ISK amount that was paid when tour was booked and is not liable for any losses incurred by the Customer in the event that the currency exchange rate of Customers currency has changed between time of purchase and time of refund.

 

If Icethor.is cancels a tour for any reason, re-scheduling and/or alternatives may be offered/suggested in an effort to ensure customer satisfaction. The Customer is free to either accept or decline such offers.

If The Customer declines re-scheduling or alternative offers, The Customer receives a 100% refund. Should The Customer accept an offer for an alternative service or re-schedule, the booking has become binding in much the same way as the original booking from the time The Customer accepts such an offer. Thus in case of cancellation by The Customer, the Cancellation/refund terms as stated in these Terms & Conditions do apply.

Tour specific Terms & Conditions (To be viewed as an addition to the General Terms & Conditions) for the following tours:
Northern Lights Experience

Cancellation by Icethor.is 

Icethor.is reserves the right to delay, alter or cancel any tour due to weather or any other unsafe conditions for the safety of our clients. We make our Go/NoGo decision at 18:30 based on the last weather forecast for the evening. If it’s a NoGo due to weather we send you an e-mail. In the event of sudden late weather changes/warnings we may need to cancel last minute, in which case we will send an e-mail. If we cancel your tour because of weather, we can rebook you on our next available tour. Please request a rebooking via e-mail to icemotion@outlook.com If we do not manage to take you out at all during your stay you receive a 100% refund.

 

Pickup:

Note that pickup time is anywhere from 0 to 30 minutes till the stated beginning of tour. If a customer is not present at provided pickup location when our driver-guide arrives, the driver-guide is obliged to continue pickup of other customers and start the tour without the missing customer. This is to avoid delay for other customers. In such case, this is considered a NO SHOW and no refund will be issued.

Non-sightings on tour:

The Northern Lights are a natural phenomenon and displays, or their magnitude, can never be guaranteed.  Low level lights count as sightings. If we do not see Northern Lights on your tour, you are eligible for a free re-run any time for a period of two years from the date of the non-sightings tour. Number of free re-run’s is not limited. You may be required to present your original ticket/voucher via e-mail upon requesting your free re-run. Free re-run right is non-transferable to a third party. A free re-run tour is subject to availability. I.e. there must be available seats when you notify us via e-mail that you would like to book a re-run and there must be a tour scheduled. In this case you must notify us by e-mail: icemotion@outlook.com  Re-booking is on a first come, first served basis. Under no circumstances will there be a refund, in full or partial, for a Non-sightings tour.

Law and disputes

These terms and conditions should be interpreted in accordance with Icelandic law. In the event of a dispute or if any person considers that he has a claim against Icethor.is on the basis of terms and conditions, such dispute or claim will be referred to the Icelandic court for consideration.
